QTIS AI TERMS OF SERVICE

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and QTIS AI Corp (“QTIS AI,” “QTIS,” “we,” “us,” or “our”) governing your access to and use of the QTIS AI application, platform, websites, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
Eligibility
You represent and warrant that you are at least eighteen (18) years of age or have reached the age of majority in your jurisdiction, and that you possess the legal authority and capacity to enter into this agreement.
License Grant
Subject to your compliance with these Terms, QTIS AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for their intended purposes.
Except as expressly permitted, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services.
All rights not expressly granted are reserved by QTIS AI.
User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You agree to provide accurate and complete information.
QTIS AI shall not be responsible for unauthorized access resulting from your failure to safeguard credentials.
User Data and Content
You retain ownership of data, images, communications, and materials submitted through the Services (“User Data”).
You represent and warrant that:
• You have all necessary rights to provide User Data
• User Data does not violate applicable laws or third-party rights
• Required consents have been obtained
You grant QTIS AI a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and display User Data solely for the purpose of operating, improving, securing, and providing the Services.
Artificial Intelligence and Automated Features
The Services may include AI-generated outputs, analytics, predictions, or recommendations. Such outputs are provided for informational purposes only.
QTIS AI makes no representations or warranties regarding the accuracy, reliability, completeness, or suitability of AI-generated content.
You acknowledge that reliance on AI outputs is at your sole risk.
No Medical or Professional Advice
The Services do not provide medical, legal, financial, or other professional advice. All content is informational only and is not a substitute for consultation with qualified professionals.
Acceptable Use
You agree not to:
• Use the Services for unlawful purposes
• Upload harmful, infringing, or illegal content
• Interfere with system security or integrity
• Attempt unauthorized access
QTIS AI reserves the right to suspend or terminate access for violations.
Intellectual Property
All Services, including software, content, AI systems, trademarks, and related technology, are and remain the exclusive property of QTIS AI or its licensors.
No rights are transferred except as expressly stated.
Third-Party Services
The Services may integrate with third-party platforms. QTIS AI is not responsible for third-party services, content, privacy practices, or failures.
Service Availability
QTIS AI does not guarantee uninterrupted or error-free operation. Services may be modified, suspended, or discontinued at any time.
Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.
Limitation of Liability
To the fullest extent permitted by law, QTIS AI and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, revenue, or business opportunities.
QTIS AI’s aggregate liability arising out of or relating to the Services shall not exceed the greater of:
(a) The total amounts paid by you to QTIS AI during the twelve (12) months preceding the claim, or
(b) One hundred U.S. dollars (USD $100)
This limitation applies regardless of the legal theory asserted.
Indemnification
You agree to indemnify, defend, and hold harmless QTIS AI and its affiliates from any claims, damages, liabilities, losses, costs, and expenses arising from:
• Your use of the Services
• Your User Data
• Your violation of law or third-party rights
• Your breach of these Terms
Termination
QTIS AI may suspend or terminate your access at any time. Upon termination, your right to use the Services immediately ceases.
Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
Arbitration and Class Action Waiver
Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration conducted in Delaware under the rules of the American Arbitration Association.
You waive any right to participate in a class or representative action.
Force Majeure
QTIS AI shall not be liable for failures or delays resulting from causes beyond reasonable control.
Modifications
QTIS AI reserves the right to modify these Terms. Continued use of the Services constitutes acceptance of revised Terms.
Severability
If any provision is deemed unenforceable, remaining provisions remain in effect.
Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and QTIS AI.
